PUBLIC OFFER AGREEMENT
This public offer to provide funds and other property (hereinafter - the Offer) as a donation of individuals and legal entities (hereinafter - the Donor) is aimed for an indefinite number of persons and is a public proposal PUBLIC ORGANIZATION "DEMOCRATIC AX" Chairman, Shvets Anton Andriyovych (hereinafter - the Organization) , to make an agreement about providing of membership fees/donations on the following terms:
1. General provisions
1.1. The contractual relationship between the Donor and the Organization is formalized in the form of a Public Offer Agreement. Clicking on the website https://sokyra.space in the relevant section of the “PAY” button means that the Donor, regardless of legal status (individual, legal entity), in accordance with applicable law, has accepted terms of the Public Offer Agreement (acceptance), which are specified below.
1.2. This Agreement is public, ie in accordance with art. 641 of the Civil Code of Ukraine, its conditions are the same for all Donors.
1.3. This Agreement will enter into force after clicking on the "PAY" button, and means the Donor agrees to make a donation.
1.4. In order to regulate contractual relations under the Agreement, the Parties shall select and, if necessary, apply Ukrainian legislation. If an international agreement, approved by the Verkhovna Rada of Ukraine, establishes other rules than those established by Ukrainian law, the rules of the international agreement will apply.
2. Terms and definitions of the Agreement
2.1. TERMS AND DEFINITIONS:
<0>"Public Offering Contract" means a public contract, a sample of which is available on the website https://sokyra.space , which contains the Organization's offer to make a donation to an unspecified number of persons.
"Acceptance" - acceptance by the Donor of the proposal of the Organization to make a donation by paying it into the current account of the Organization.
"Donation" - free transfer of funds by the Donor to the ownership of the Organization for further use to achieve the statutory objectives of the Organization, provided by the Charter of the Organization.
"Donor" - any able-bodied individual, legal entity , according to the current Ukrainian legislation, who have visited Website https://sokyra.space and intend to make a Donation.
"Organization" - PUBLIC ORGANIZATION «DEMOCRATIC AX», which is registered and operates in accordance with the Constitution of Ukraine, the Law of Ukraine "About Public Associations" and other acts of legislation, including collecting donations through the Website https://sokyra.space .
"Legislation" - established by Ukrainian or international law rules for the regulation of contractual relations under the Contract.
3. Scope of the Contract
3.1. The subject of this Agreement is the gratuitous and voluntary transfer of funds by the Donor to the ownership of the Organization by making a donation to help ensure the statutory activities of the Organization.
3.2. Any actions by the parties of this Agreement are not intended to generate profit and its distribution or any benefits for either party.
4. Rights and Responsibilities of the Organization
4.1. Organization's responsibilities:
- to act according to the terms of this Agreement;
- to use the funds donated by the Donor exclusively to fulfill the Statutory purpose of the Organization and according to the terms of this Agreement;
4.2. Organization's Rights:
- to change the directions of use of the donation within the Statutory activities of the Organization according to the Donor wishes.

0>6. Period of fundrising
6.1. Public fundraising lasts until the termination of the Organization (reorganization or liquidation) or any other specified decision of the Organization. The Donor will be notified by posting relevant information on the website: https://sokyra.space.
7. Procedure of the Payment and Use of the Donation
7.1. The use of the donation is carried out in accordance with the purposes set out in the Charter of the Organization, the Law of Ukraine "About Public Associations" and the Tax Code.
7.2. The Donor may make the Donation in the following ways:
1) via bank transfer to the current account of the Organization specified in the account, including using Internet banking.
2) via credit card of the following type:
- Visa
- Visa Electron
- Mastercard
- Mastercard Electronic
- Maestro
3) via any other way as agreed with the Organization.
8. Liability of the parties and dispute resolution
8.1. The Organization bears responsibility for breaking the terms of this Agreement and for any non-agreed use of Donations in accordance with the procedure established by this Agreement, according to the current legislation of Ukraine.
8.2. All disputes, disagreements or claims, which arise according to this Agreement, including those relating to its performance, violations, termination or invalidity, will be settled in the court in accordance with international and Ukrainian substantive and procedural law.
9. Інші умови
9.1. This agreement is concluded on the territory of Ukraine and obeys to the substantive law of Ukraine.
9.2. The invalidation of any clause or part of this agreement does not lead to the invalidity of the whole agreement.
9.3. All disputes arising between the Parties shall be settled through negotiations. In case of failure to resolve the dispute, the Parties may apply to the courts for resolution of the dispute in accordance with applicable law.
9.4. The Organization has the right to make changes to the text of this agreement at its discretion at any time and without prior notice to the Donors. The current (valid) version of the agreement is always available on the Site.
9.5. By accepting the Agreement or registering on the Website https://sokyra.space (filling in the registration form), the Donor voluntarily consents about the collection and processing of their personal data.
For the purposes of this Agreement, the Organization has the right to send letters, messages and materials to the Donor via post address, e-mail of the Donor, as well as send sms-messages, make calls via telephone number, which was specified in the questionnaire.
9.6. The Donor gives the right to process his personal data, including: placing personal data in the database (without additional notice), to carry out lifelong data storing, data accumulation, update, changes (if necessary) . The organization undertakes to protect data from unauthorized access by third parties, not to disseminate or transfer data to any third party (except as provided by law, including requests of the competent state authority, court decisions, etc.) .
9.7. In case of unwillingness to receive the newsletter, the Donor has the right to apply to the Organization by writing a statement about refusing to receive news materials, sending it to the postal or e-mail address.
